Rules for using the bricksfunding.cz website, the waiting list, the contact form and related services operated by Bricks Funding a.s.
English translation for convenience. The legally binding version is the Czech text.
1. Operator
The bricksfunding.cz website is operated by Bricks Funding a.s., Company ID (IČ) 239 60 531, with its registered office at Komořanská 2428/17, Modřany, 143 00 Prague 4, registered in the Commercial Register maintained by the Municipal Court in Prague, Section B, Insert 30105 (“we”, “Bricks Funding”). 2. Scope of the website
The website presents information about Bricks Funding, about the properties in the portfolio and about the structure of the bond issues, and allows you to join the waiting list and send enquiries. The actual investment in a specific bond, KYC and the subscription agreement are handled in a separate investment platform, account.bricksfunding.cz, under separate terms.
3. Applicability of these terms
These general terms and conditions govern exclusively the use of the www.bricksfunding.cz website. They do not apply to the bond issues themselves, nor to the rights and obligations of Bricks Funding as issuer or of the bondholders. Those legal relationships are governed by the issue terms of the relevant bond issue, by the contractual documentation concluded through the investment platform, and by the applicable legislation.
4. The website is not an investment offer
The information published on the website is for information purposes only. It does not constitute an investment recommendation, an offer to sell, or a solicitation to buy any security. Any investment decision must be based on the binding issue terms of the relevant bond.
5. Waiting list
Joining the waiting list is voluntary, free of charge and does not create any obligation on either party. It is not an investment, a subscription or a binding offer. You may cancel your waiting-list entry at any time by replying to an e-mail from Bricks Funding or by sending a message to: gdpr@bricksfunding.cz.
6. Rules of use
- The website may be used only for lawful purposes.
- It is prohibited to attempt unauthorised access, to bulk-download content, to disrupt operation and to upload malicious code.
- The information you provide in the forms must be truthful.
7. Intellectual property
All website content (texts, design, logos, photographs, diagrams) is the property of Bricks Funding or its licensors and is protected by copyright law. Reproduction or re-publication of the content is not permitted without prior written consent, except for short quotations with attribution of the source.
8. Limitation of liability
We strive to keep the information on the website accurate and up to date. However, we do not guarantee that it is free of errors, omissions or outages. Bricks Funding is not liable for damage arising from reliance on the general information on the website. The information set out in the binding issue terms and in other documents directly associated with a specific bond issue prevails over the information on this website.
9. Third-party links and services
The website links to third-party sources (e.g. the Cadastre of Real Estate, the Commercial Register, the inGain investment platform). We are not responsible for their content or availability.
10. Changes to the terms
We may update these terms. The current version, with its effective date, is always published on this web page. We inform waiting-list registrants of material changes by e-mail.
11. Governing law
These terms are governed by the laws of the Czech Republic, without prejudice to the mandatory consumer-protection rules of your country of residence. Disputes are resolved by the competent courts of the Czech Republic.
